Terms of Service

These Terms of Service ("Terms") govern your use of হিসাব খাতা (the "Service"), an online HR, attendance, payroll and finance tool operated by হিসাব খাতা (Hishab Khata) ("we", "us"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a business, you confirm you have authority to bind that business.

1. The Service

হিসাব খাতা helps businesses manage employees, attendance (including QR check-in), leave, payroll, income and expenses, reports, notices, and an activity log, with a separate self-service portal for employees.

The Service is a management aid. Payroll, tax, leave and other figures are calculated from the data and settings you enter. We do not provide legal, tax, accounting or labour-law advice, and you remain responsible for checking that amounts and practices comply with the laws that apply to your business, including labour and tax laws in Bangladesh.

2. Accounts and roles

Registering creates an organization and its first administrator. Access inside an organization depends on role:

  • Organization Admin — full control of the organization, including settings, team, billing and the activity log.
  • Manager — day-to-day operations such as employees, attendance, leave, payroll, finance and reports.
  • Employee — a self-service portal limited to that employee’s own attendance, leave, payslips and notices.
  • Platform administrator — a single account operated by us that oversees all organizations for support, billing and security purposes.

You must give accurate information, keep your password confidential, and tell us promptly if you suspect unauthorised use. You are responsible for all activity under your account and for the accounts you create or invite. Organization Admins are responsible for granting, changing and removing access for their team.

3. Your data and your responsibilities

Your organization owns the data it enters (employee records, attendance, payroll, finance and so on). You grant us a limited licence to host, process and display it solely to provide and secure the Service.

As the organization, you are responsible for:

  • having a lawful basis, and any required consent or notice, for entering your employees’ personal data (such as national ID, bank details, salary and attendance) and for using QR or self-service check-in;
  • the accuracy of the data, shifts, working days, leave policies and payroll settings you configure;
  • reviewing payroll before marking it paid — a payroll marked as paid is final in the Service;
  • keeping your own records and copies you need for legal or accounting purposes.

4. Plans, free trial and payment

  • New organizations start with a 14-day free trial. Plans (Free, Basic, Pro and Enterprise) limit the number of active employees; current limits and prices are shown in Settings → Billing.
  • Paid plans are billed per month and paid online through our payment gateway (SSLCommerz). We do not store card or mobile-wallet credentials. A plan is activated only after the gateway confirms the payment to us.
  • If a trial or paid plan ends, the organization returns to the Free plan limits. Your data is kept; you simply cannot add active employees above the limit until you renew.
  • Fees are non-refundable except where required by law or where we state otherwise in writing. We may change prices or plan limits with reasonable notice; changes apply from your next billing period.

5. Acceptable use

You agree not to:

  • use the Service for anything unlawful, fraudulent or that infringes others’ rights;
  • access data of another organization, or try to bypass access controls, rate limits or security features;
  • probe, scan or test the Service for vulnerabilities without our written permission, or disrupt or overload it;
  • upload malware or content you have no right to upload;
  • resell or provide the Service to third parties without our agreement.

6. Activity log and monitoring

The Service records an audit trail of actions taken in your organization (for example sign-ins, employee changes, attendance, leave decisions, payroll runs, finance changes and settings changes). Organization Admins can see their organization’s log; the platform administrator can see logs across organizations. Organizations are responsible for informing their staff that such logging takes place.

7. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate an organization or account if these Terms are breached, if payment is fraudulent or disputed, if required by law, or to protect the Service and its users. While an organization is suspended its users cannot sign in; its data is retained and access is restored if the suspension is lifted.

Ask us before terminating if you need an export of your data. After termination we may delete or anonymise your data after a reasonable period, except where we must keep it by law or for legitimate accounting and security records.

8. Availability and changes

We work to keep the Service available and secure, but it is provided on an “as is” and “as available” basis. We do not promise uninterrupted or error-free operation and may perform maintenance, update or change features. Make sure you keep your own backups of important records.

9. Intellectual property

The Service, its software, design and branding belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use it for your internal business purposes while these Terms apply. You keep ownership of your own data.

10. Disclaimers and limitation of liability

To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including fitness for a particular purpose and that calculated figures will be free of error or suit your legal obligations.

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss (such as lost profit, lost data or business interruption), and our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the three months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Changes to these Terms

We may update these Terms. If a change is material we will give notice in the app or by e-mail before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.

12. Governing law and contact

These Terms are governed by the laws of Bangladesh, and the courts of Bangladesh have jurisdiction over disputes, unless mandatory law provides otherwise.
